North Palm Beach Heights Water Control District- Summary Description

The North Palm Beach Heights Water Control District was created in the late 1950’s by judicial decree but it is now governed by Florida Statute Chapter 298.

Chapter 298 provides for a Board of Supervisors of three members who each serve for a staggered term of three years. Each Supervisor must be a resident of the Heights. The statute provides that there must be an annual landowners meeting. At the meeting there is an election for the Supervisor’s seat that is u0o for election that year and the District engineer gives a report of the work done over the previous year. For purposes of electing a Supervisor, each acre(or less than one acre) of land in the sitrict is entitled to one vote per acre.

The Board of Supervisors elects one Board member to serve as president(Chairman)of the Board. The Board also is responsible for appointing a District Secretary, Treasurer, District Engineer, and District Attorney.

The statute establishes the powers of the Board of Supervisors. Some of these powers include the power to tax, employ persons, purchase machinery, maintain canals, build and construct works, purchase and/or condemn land, adopt resolutions, etc.

Each year the District passes a budget for the coming year. This takes place at a public meeting(all District meetings are open to the public). The District, by law, must notify each landowner of the record via first class mail of the date, time and nature of the meeting.
